Terms & Conditions
These terms cover everything you can expect from us, and what we ask of you in return, when you order a Serenade. We have tried to write them in plain language. If anything is unclear, email support@serenade.media.
1. Acceptance of these terms
By placing an order through Serenade, you agree to be bound by these Terms & Conditions and by our Privacy Policy and Refund Policy. We may update these terms from time to time; the date at the top of this page reflects the most recent change. Continuing to use Serenade after that date constitutes acceptance of the updated terms.
2. Who we are
Serenade composes original, AI-generated songs for personal moments. Throughout these terms, “Serenade”, “we”, “our”, and “us” refer to the operator of this website and service. You can reach us at support@serenade.media.
3. What you are buying
Serenade offers two packages:
- Standard Serenade — one original song of roughly 2.5 to 4 minutes.
- Premium Serenade — two original songs.
Prices are shown and charged in your local currency (USD, CAD, AUD, or NZD) based on your location. The exact amount is always displayed at checkout before you pay.
Songs are delivered as HD MP3 audio via a private link, typically within seven days of payment confirmation. Delivery time is a target, not a guarantee; complex orders or short-term outages with our model providers can extend it.
4. How your song is created
Each Serenade is composed by combining the answers you provide in the quiz with a multi-stage AI pipeline:
- The lyrics are written by Anthropic’s Claude language model.
- The audio is generated by MiniMax Music 2.6.
- Both models are accessed through Replicate.
Your song is unique to your order. It is not a pre-existing track, a cover, a remix, or a karaoke version of any other work. Because each output is generated fresh, no two orders produce identical results.
5. Your content and the quiz
When you complete the Serenade quiz, you provide details about the recipient, their qualities, shared memories, and a personal message. By submitting this information, you confirm that you have the right to share it and that doing so does not violate any third party’s rights or applicable law. You grant Serenade a limited, non-exclusive licence to process this content for the sole purpose of generating and delivering your song.
6. Your licence to the song (personal use only)
Upon delivery, you receive a perpetual, worldwide, non-exclusive, non-transferable licence to:
- Stream and download the song for your own listening.
- Share it privately with the recipient and with your friends and family.
- Use the song for personal, non-commercial purposes only.
You may not:
- Resell, sublicense, or assign the song to any third party.
- Monetise the song on Spotify, Apple Music, YouTube, TikTok, or any other streaming, sync, or licensing platform.
- Broadcast the song publicly, including in advertising, retail spaces, or commercial productions.
- Claim authorship of the song or its lyrics.
Serenade retains all underlying intellectual property rights in the song, the lyrics, and the underlying model outputs.
7. Revisions
Each song in your order includes one complimentary revision. To request one, email support@serenade.media with your order ID and a description of what you would like changed. Requesting a revision is treated as acceptance of your original song for the purposes of our Refund Policy.
8. Acceptable use
You agree not to submit content through Serenade that:
- Promotes hate, harassment, or violence against any person or group.
- Is defamatory, threatening, or sexually explicit.
- Infringes on a third party’s intellectual property, privacy, or other rights.
- Is otherwise unlawful in your jurisdiction or ours.
We may refuse, cancel, or refund any order that violates this section, at our sole discretion.
9. AI generation disclaimers
Serenade songs are produced by algorithmic systems. While we put care into the prompts and models we use, AI output is not deterministic. We do not warrant that any song will be:
- Stylistically identical to the genre, mood, or voice you requested.
- Free of incidental melodic, lyrical, or stylistic similarity to existing works.
- Free of artefacts, mispronunciations, or other audio quirks.
If you are not happy with your song, your remedies are the revision and refund processes set out in our Refund Policy.
10. Account and order data
You are responsible for the accuracy of the email address you provide at checkout. We deliver songs to a private link at /delivery/<your-order-id> and send a notification to that email address. Serenade is not responsible for missed deliveries caused by an incorrect or inaccessible email address.
11. Service availability
Serenade is provided on an “as available” basis. We may modify, suspend, or discontinue any part of the service at any time, with or without notice. We do not offer a service level agreement or uptime guarantee.
12. Limitation of liability
To the maximum extent permitted by law, Serenade’s total liability to you for any claim arising out of or relating to your use of the service is capped at the amount you paid Serenade for the order to which the claim relates. Serenade is not liable for any indirect, incidental, consequential, special, or punitive damages.
13. Indemnity
You agree to indemnify and hold Serenade harmless from any claim, loss, or expense (including reasonable legal fees) arising from content you submit to the quiz, your breach of these terms, or your misuse of any song delivered to you.
14. Governing law and disputes
These terms are governed by the laws of the jurisdiction in which Serenade is operated. Before initiating any formal dispute, you agree to contact us at support@serenade.media and attempt to resolve the matter through good-faith discussion. Any unresolved dispute will be referred to binding arbitration in that jurisdiction, conducted in English. You waive any right to participate in a class or representative action.
15. Changes to these terms
We may update these terms periodically. When we do, we will revise the “Last updated” date at the top of this page. Continued use of Serenade after a change indicates your acceptance of the updated terms.
